Terms of Service

1. Acceptance of Terms

By accessing or using the Come-For Sales GPS application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the App.

These Terms constitute a legally binding agreement between you and Come-For LLC ("Company", "we", "us", or "our").

2. Eligibility & Authorization

The App is intended solely for:

• Authorized employees of Come-For LLC
• Authorized contractors and sales representatives working on behalf of Come-For LLC

You must be at least 18 years of age to use the App. Access is granted by a Company administrator and may be revoked at any time.

3. Account Responsibilities

3.1 Account Security

• You are responsible for maintaining the confidentiality of your account credentials.
• You must not share your login information with anyone.
• You must immediately notify the Company if you suspect unauthorized use of your account.

3.2 Accurate Information

You agree to provide accurate, current, and complete information when using the App. This includes but is not limited to visit notes, customer information, and task updates.

4. Acceptable Use

You agree to use the App only for its intended business purposes. You must not:

• Use the App for any illegal or unauthorized purpose.
• Attempt to bypass or disable GPS tracking or location verification features during work hours.
• Falsify visit records, attendance data, or any other information in the App.
• Attempt to access data belonging to other users without authorization.
• Reverse engineer, decompile, or disassemble any part of the App.
• Transmit viruses, malware, or other harmful code through the App.
• Use the App in any way that could damage, disable, or impair the service.
• Extract or scrape data from the App for unauthorized purposes.
• Share confidential customer data obtained through the App with unauthorized third parties.

5. GPS Tracking & Location Services

• The App tracks your precise GPS location during active work shifts (between check-in and check-out).
• Location data is used for customer visit verification (40-meter proximity check), route tracking, and attendance monitoring.
• You must enable location services on your device for the App to function correctly.
• Deliberately providing false location data or using location spoofing tools is strictly prohibited and may result in disciplinary action.
• Location tracking ceases when you check out of your work shift.

6. Customer Data & Confidentiality

Through the App, you may access confidential business information including customer names, addresses, contact details, and purchase history. You agree to:

• Treat all customer data as confidential business information.
• Use customer data only for authorized business purposes.
• Not copy, export, or share customer data outside of the App without authorization.
• Report any data breaches or unauthorized access immediately.

7. Intellectual Property

The App and all its content, features, and functionality (including but not limited to software code, design, graphics, and documentation) are owned by Come-For LLC and are protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App solely for its intended purpose as authorized by the Company.

8. Content You Provide

By submitting content through the App (including visit notes, photos, and reports), you grant Come-For LLC a perpetual, worldwide, royalty-free right to use this content for business operations, reporting, and service improvement.

You represent that any content you submit:

• Is accurate and truthful.
• Does not violate any third-party rights.
• Does not contain inappropriate, offensive, or illegal material.

9. Service Availability

• We strive to maintain App availability but do not guarantee uninterrupted service.
• The App includes offline functionality for core operations during network outages.
• We may suspend or restrict access to the App for maintenance, updates, or security reasons.
• We reserve the right to modify, update, or discontinue the App at any time.

10. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The App will be error-free or uninterrupted.
• GPS location data will be 100% accurate at all times.
• The App will be compatible with all devices or operating systems.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Come-For LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, including but not limited to:

• Loss of data or business interruption.
• Inaccurate GPS data or location failures.
• Unauthorized access to your account due to your failure to maintain security.

12. Termination

• Your access to the App may be terminated at any time by the Company, with or without cause.
• Upon termination, your right to use the App ceases immediately.
• Data associated with your account will be handled in accordance with our Privacy Policy.
• Provisions regarding intellectual property, confidentiality, limitation of liability, and governing law survive termination.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes through the App or via email. Your continued use of the App after such notification constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ukraine. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ukraine.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
