End-User License Agreement (EULA)

1. Agreement to Terms

This End-User License Agreement ("EULA") is a legal agreement between you ("User", "you") and Come-For LLC ("Licensor", "Company", "we") for the use of the Come-For Sales GPS mobile application ("App"), including any updates, patches, and related documentation.

By downloading, installing, or using the App, you agree to be bound by this EULA. If you do not agree, do not install or use the App.

2. License Grant

Subject to your compliance with this EULA, the Company grants you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on a mobile device that you own or control.
• Use the App solely for its intended purpose as a workforce management tool for Come-For LLC business operations.

3. License Restrictions

You may not:

• Copy, modify, or distribute the App or any part thereof.
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App.
• Rent, lease, lend, sell, sublicense, or otherwise transfer the App or your license rights to any third party.
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices in the App.
• Use the App on any device not authorized by the Company.
• Use the App for any purpose other than authorized business operations of Come-For LLC.
• Use location spoofing, VPN-based location masking, or any other means to falsify your location data.
• Attempt to circumvent any security or access control measures of the App.

4. Ownership & Intellectual Property

The App is licensed, not sold. Come-For LLC retains all right, title, and interest in and to the App, including all intellectual property rights. This EULA does not grant you any ownership interest in the App.

All trademarks, service marks, trade names, and logos displayed in the App are the property of Come-For LLC or their respective owners.

5. Data Collection & Privacy

The App collects and processes personal data as described in our Privacy Policy. By using the App, you consent to such data collection and processing. Key data collected includes:

• Account information (name, email, phone number)
• Precise GPS location data during active work shifts
• Work activity data (tasks, visits, attendance)
• Photos and notes submitted during customer visits

6. Updates & Modifications

• The Company may release updates, patches, or new versions of the App from time to time.
• You agree to install updates in a timely manner to maintain App functionality and security.
• Some updates may be applied automatically.
• The Company may modify or discontinue the App at any time without prior notice.

7. Third-Party Services

The App uses the following third-party services, each governed by their own terms:

• Google Firebase — Authentication, database, storage, and messaging services (Firebase Terms)
• OpenStreetMap — Map data and tiles (ODbL License)

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

THE COMPANY DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT GPS LOCATION DATA WILL BE ACCURATE AT ALL TIMES.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL COME-FOR LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR RELATED TO THIS EULA OR YOUR USE OF THE APP.

THE COMPANY'S TOTAL AGGREGATE LIABILITY UNDER THIS EULA SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE APP (IF ANY).

10. Indemnification

You agree to indemnify, defend, and hold harmless Come-For LLC and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:

• Your violation of this EULA.
• Your misuse of the App.
• Your violation of any applicable law or regulation.
• Any content you submit through the App.

11. Termination

• This EULA is effective until terminated.
• The Company may terminate this EULA at any time, for any reason, by disabling your account or restricting access to the App.
• Upon termination, you must cease all use of the App and delete it from your devices.
• Sections relating to ownership, disclaimer of warranties, limitation of liability, indemnification, and governing law survive termination.

12. Apple App Store Additional Terms

If you downloaded the App from the Apple App Store, the following additional terms apply:

• This EULA is between you and Come-For LLC only, and not with Apple Inc.
• Apple has no obligation to provide maintenance or support for the App.
• In the event of the App's failure to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). Apple has no other warranty obligation.
• Apple is not responsible for addressing any claims relating to the App or your use of the App.
• Apple is a third-party beneficiary of this EULA and has the right to enforce it against you.

13. Google Play Store Additional Terms

If you downloaded the App from the Google Play Store, the following additional terms apply:

• This EULA is between you and Come-For LLC only, and not with Google LLC.
• Google has no obligation to provide maintenance or support for the App.
• Google is not responsible for any claims arising from the App.

14. Export Compliance

You agree to comply with all applicable export and import laws and regulations. You may not export or re-export the App except as authorized by Ukrainian law and the laws of the jurisdiction in which the App was obtained.

15. Governing Law & Dispute Resolution

This EULA shall be governed by and construed in accordance with the laws of Ukraine, without regard to its conflict of law provisions. Any dispute arising under this EULA shall be resolved in the courts of Ukraine.

16. Entire Agreement

This EULA, together with the Privacy Policy and Terms of Service, constitutes the entire agreement between you and the Company regarding the App and supersedes all prior agreements.
